1. Eligibility

By accessing the Platform, you represent and warrant that you meet these eligibility requirements.
To use certain features of the Platform, you must create an account. You are responsible for maintaining the confidentiality of your account information.
You agree to provide accurate, current, and complete information during registration and to update your information as necessary.
You are solely responsible for all activities that occur under your account.
3.1 Listing
TVirtual Studios artists and partners may mint and list NFTs on the Platform, provided they comply with our content guidelines and applicable laws.
By listing an NFT, you must have completed the buying process yelding a registered record automatically generated at Polygon Blockchain Network.
3.2 Purchases
When purchasing an NFT, you acknowledge that you are buying a unique digital asset, not intellectual property rights to the underlying content unless explicitly stated.
All transactions are processed through blockchain technology, and you acknowledge that blockchain transactions are irreversible and immutable.
3.3 Fees
TVirtual may charge fees for minting, listing, or transacting NFTs on the Platform. These fees will be clearly communicated before you complete any transaction.
Ownership of an NFT purchased on the Platform is governed by the smart contract and does not include ownership of intellectual property rights to the associated content unless explicitly stated by the creator.
Creators grant limited licenses to use, display, and resell the NFT’s associated content solely for personal, non-commercial purposes (other than the trade transaction profit of selling the investment in a NFT item) unless otherwise specified.
You agree not to:
Engage in any activity that violates applicable laws or regulations.
Use the Platform to mint or trade NFTs that infringe upon third-party rights, including intellectual property rights.
Engage in fraud, manipulation, or other deceptive practices.
Attempt to disrupt or harm the Platform’s infrastructure or security.
The Platform is provided "as is" and "as available" without any warranties of any kind, express or implied.
We do not guarantee the accuracy, completeness, or reliability of any content on the Platform.
We are not responsible for any losses incurred due to blockchain network issues, gas fees, or third-party actions.
To the fullest extent permitted by law, TVirtual shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Platform.
Our total liability to you for any claims arising under these Terms shall not exceed the greater of $100 or the amount paid by you to us in the past 12 months.
You agree to indemnify and hold harmless TVirtual, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses arising out of or connected to your use of the Platform or violation of these Terms.
We may suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice.
Upon termination, any provisions of these Terms that by their nature should survive termination shall remain in effect.
We reserve the right to update or modify these Terms at any time. Changes will be effective upon posting on the Platform.
Continued use of the Platform after changes constitutes acceptance of the updated Terms.
